Terms of Service
Last updated 30 August 2026
These terms apply to coaching services provided by Hegs Performance ("I", "me", "my") to you as a client. By signing up and making your first payment you accept them.
1. What you're buying
Online or in-person coaching on one of three plans — Foundation, Extended or Pro. What each plan includes is set out on the signup page at the time you join. Coaching is a personal service delivered by me; it is not a product, a guarantee of a specific physical result, or medical treatment.
2. Payment
- If you join through the signup form, your first payment covers your first two weeks. From week three, payment is weekly in advance.
- If you join through a direct payment link, your first payment covers your first week, and payment continues weekly in advance after that.
- All prices are in Australian dollars.
- Card payments are processed by Stripe. Your card details are handled by Stripe and are never stored by Hegs Performance. Payment by PayID or bank transfer is also accepted, quoting the reference shown on your signup confirmation.
- Coaching begins once your first payment is received, not when you submit the form.
3. Cancellation
There is no lock-in contract. You can stop at any time by telling me. Cancellation takes effect at the end of the period you have already paid for; simply stopping payment without telling me is treated as cancellation from the end of your last paid week.
4. Refunds
Once a payment has been taken, the period it covers is not refundable. You keep full access to coaching for the whole period you have paid for.
Cancelling stops all future payments. If you cancel shortly after a payment has come out, you are not refunded for that period, but nothing further will be charged. For example, if your weekly payment is taken on a Sunday and you cancel on the Monday, you keep coaching for the rest of that week and no payment is taken the following week.
You can cancel at any time through the client billing portal or by telling me directly.
Nothing in these terms excludes your rights under the Australian Consumer Law, including the right to a remedy where a service is not supplied with due care and skill.
5. Your responsibilities
- Tell me about any injury, medical condition, medication or pregnancy before you start, and if anything changes.
- Give honest information in your intake and check-ins — the plan is built from it.
- Train within your capability and stop if something hurts.
6. Health and medical disclaimer
I am a coach, not a doctor, dietitian or allied health professional. Coaching does not replace medical advice, diagnosis or treatment. You should speak to your doctor before starting a new training or nutrition program, particularly if you have an existing condition. You take part at your own risk.
7. Programs and materials
Training programs, meal plans and written materials I provide are for your personal use. Please don't redistribute or resell them.
8. Client portal
Your program, check-ins and progress are hosted in the Apex client portal. Your account is created against the email address you signed up with — keep your login details to yourself.
9. Conduct
I may end coaching immediately, refunding any unused prepaid period, if a client is abusive, or asks me to assist with something unsafe or unlawful.
10. Changes
I may update these terms. Existing clients will be told before any change affecting price or cancellation takes effect. Price changes never apply to a period you have already paid for.
11. Governing law
These terms are governed by the laws of Victoria, Australia.
